5. Orders and Payment (Direct-to-Consumer Sales)

5.2 Pricing
Prices for products are subject to change at any time. The price displayed at the time of order placement is the price we will charge, provided the order is accepted before any price change takes effect. We are not responsible for typographical, pricing, or photographic errors.

Payment must be received in full before shipment, unless otherwise arranged for approved wholesale accounts. We accept most payments. By providing payment information, you represent that you are authorized to use the payment method.

5.4 Billing Errors
If we discover a billing error or are unable to verify payment information, we may cancel the order or contact you for additional information. You are responsible for ensuring your billing information is accurate and current.

6. Shipping and Delivery

6.1 Shipping Areas
We ship to United States and Canada. We do not ship to P.O. Boxes or military addresses (APO/FPO/DPO) unless otherwise stated. We reserve the right to restrict shipping to certain locations based on product type, perishability, regulatory requirements, or carrier limitations.

6.2 Shipping Methods and Costs
Shipping costs, delivery estimates, and methods will be displayed at checkout for D2C orders. Wholesale/B2B shipping terms are governed by the applicable wholesale agreement (see Section 13). We are not responsible for delays caused by carriers, force majeure events, weather, customs delays (for international shipments), incorrect or incomplete address information provided by the customer, or other circumstances beyond our control.

6.3 Perishable Products
Many of our products are perishable or require temperature-controlled storage and transport (e.g., refrigerated or frozen items). We take reasonable measures to ship perishable products with appropriate packaging and carrier selection. However:

– **Delivery Timing:** It is your responsibility to ensure that someone is available to receive perishable shipments and to properly store them upon arrival. If you will not be available, you must provide alternate delivery instructions.
– **Heat/Cold Damage:** We are not responsible for damage to perishable products caused by extreme weather conditions, carrier handling, delayed deliveries, or failure to receive and store products promptly upon arrival.
– **Seasonal Restrictions:** During periods of extreme temperatures, we may restrict or suspend shipping of certain perishable products to certain locations. We will make reasonable efforts to notify customers of such restrictions.

6.4 Inspection Upon Delivery
Upon receipt of any shipment, you should inspect the packaging and products for signs of damage, spoilage, or temperature abuse **before signing for or accepting the delivery**. If you notice any issues, note them on the delivery receipt or otherwise document them and contact us immediately (see Section 9). Failure to report issues at the time of delivery may limit our ability to investigate or remedy the situation.

6.5 Partially Shipped Orders
If an order contains multiple items and some are unavailable, we may ship the available items and refund or backorder the unavailable items. You will be notified of any such partial shipment.

7. Shelf-Stable Products

Shelf-stable products are those that do not require refrigeration and are safe at room temperature when stored properly and within their shelf life. Even shelf-stable products have expiration dates and storage requirements. You are responsible for:
– Checking expiration/best-by dates before consumption
– Storing products according to label instructions
– Discarding any product that shows signs of spoilage, package damage, or off-odors

8. User Accounts

8.1 Account Registration
If the Site allows you to create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

8.2 Account Restrictions
We reserve the right to suspend or terminate accounts at any time, without notice, for conduct we believe violates these Terms or is harmful to other users, us, or third parties.

8.3 Wholesale/B2B Accounts
Access to wholesale pricing, bulk ordering, or B2B features may require a separate application, approval, and/or signed wholesale agreement. Wholesale pricing and terms are not available to the general public and are subject to minimum order quantities, volume requirements, and other terms that may be set forth in a separate agreement.

9. Returns, Refunds, and Claims

9.1 Food Products — General Policy
Due to the nature of food products, **we generally do not accept returns of food items once they have left our control**, except in the following circumstances:
– The product arrived damaged, spoiled, or otherwise defective
– The product was shipped to you in error (wrong item)
– The product is otherwise not as described or not of acceptable quality

9.2 Reporting Issues
To report a problem with a product, contact us within a reasonable time after discovering the issue — and in any event no later than [e.g., 48 hours or 7 days] after delivery. You must provide:

Returns of non-food items (e.g., promotional merchandise, packaging, branded items) may be accepted under conditions described at the time of purchase or upon request.

9.5 Wholesale Returns
Returns for wholesale/B2B orders are governed by the applicable wholesale agreement. Unless otherwise agreed in writing, wholesale returns may be subject to restocking fees, minimum return quantities, and requirements that products be returned in original, unopened, and undamaged packaging.

10. Product Liability and Disclaimers

10.1 No Warranty
All products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 Limitation of Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

11. Intellectual Property
